Subject: Important update about RGL’s action against Clydesdale and Yorkshire banks
Sent: 24th July 2017 4:39pm
Dear Member
RGL are delighted to be able to update you on some important developments.
Funding
You may have already read in the press that we have funding from Augusta Ventures Limited to prosecute litigation on behalf of our SME members. Augusta is one of the largest and most respected litigation funders in the UK. We expect to issue claims this year, with precise timing dependent on tactical considerations, meaning that things could happen very quickly. Therefore, we need any information we have requested, as soon as possible.
Strength in numbers
While it’s important to move forward as quickly as possible, the more people who join the RGL action, the more of a threat to the bank we become, and the greater our chance of success. We have people registering every day, but if you know anyone who has not registered on sueClydesdale.com, now is the time for them to do so. Anyone whose business suffered at the hands of Clydesdale or Yorkshire Bank should register – but especially if they had, or still have, a TBL. Please stress that:
- there is no cost or obligation;
- we don’t disclose their name without their express permission;
- we will be seeking damages for consequential losses;
- we are able to act for businesses which have been liquidated or dissolved;
- we will pay for insurance, lawyers, barristers, forensic accountants and other experts as required, meaning the entire financial risk of the litigation is shouldered by RGL;
- even if they have already had a partial settlement we may be able to further their claim.
Please forward this email to anyone who may have suffered, and ask them to complete the simple registration form at sueClydesdale.com.
Gathering evidence
As many of you know, our lawyers Michelmores have already started to contact our registrants, to start the process of gathering statements, but they first need some important background information, so:
- If you haven’t completed your questionnaire, please do so as soon as possible
- If we’ve asked you for further information on losses, or copies of documentation and correspondence, please let us have them as soon as possible
If we don’t hear from you in the next few days, Katie will chase you up, but please avoid her having to do so.
Our lawyers
Michelmores LLP are highly experienced in this type of work, and have already had successes in settling actions against Clydesdale Bank in respect of similar claims.
The case
Our claim will include fraudulent misrepresentation as well as negligent misrepresentation and negligent misstatement.
Publicity
You may have seen that our story has been featured widely in the media recently. This sort of publicity will encourage others to join us, and it also helps to put pressure onto the banks. In case you didn’t catch any of it, you can read a number of examples, including Sky News, The Scotsman, and the Sunday Times, on our Press page.
We look forward to working with you on your claim.
Yours sincerely
